In 2023, U.S. consumers lost $10 billion to social-media-facilitated scams โ up 22% from the year before, according to an FTC report released in early 2024. The platforms didn't run those scams. But more than 40 state attorneys general are now arguing that platform design choices made users easier to exploit, and that the companies profited from it. That argument is social media company addiction liability, explained in the plainest terms possible: if you engineered the addiction, you share the harm.
This is no longer a fringe legal theory. It's in federal court.
What the Liability Argument Actually Claims

Plaintiffs aren't arguing that platforms are responsible for every regretted purchase. The legal theory is narrower and harder to dismiss:
- Platforms built features โ infinite scroll, variable-reward notifications, algorithmically timed content drops โ that they knew created compulsive use.
- Users in compulsive-use states show measurably higher rates of impulse spending and susceptibility to financial fraud.
- Platforms sold ad inventory priced on engagement depth, meaning they directly monetized those compulsive states.
That chain shifts the question from "did you host bad content?" to "did you keep users in a state that made them profitable to exploit?" It's a different argument โ and it largely sidesteps Section 230 of the Communications Decency Act, the law that has shielded platforms from most lawsuits since 1996.
Why Section 230 Doesn't Fully Cover This
Section 230 protects platforms as publishers of third-party content. Platforms have used it aggressively to kill lawsuits for decades.
But in Gonzalez v. Google (2023), the Supreme Court declined to extend Section 230 protection to algorithmic recommendations. The court didn't rule against Google โ but it refused to endorse the idea that curation decisions carry the same immunity as raw content hosting. That gap is where addiction liability cases are being built.
The design-defect framing is the key move. When plaintiffs argue that infinite scroll or push notifications are defective product features โ not content โ Section 230 doesn't apply. A hardware manufacturer can't cite Section 230 to escape a products liability suit. Whether courts treat TikTok's recommendation engine more like hardware or like editorial judgment is the central legal question in the current cases.
The Documents That Could Change Everything

The firms handling these cases โ including some that litigated tobacco and opioids โ are running a recognizable playbook. The goal is discovery: internal documents showing what companies knew, when they knew it, and what they chose not to fix.
Philip Morris lost the tobacco litigation when internal memos proved that executives knew nicotine was addictive while publicly claiming otherwise. Purdue Pharma lost the opioid litigation when sales training materials showed reps were coached to minimize addiction risk with doctors. Social media addiction cases are hunting for equivalent documents โ internal A/B tests linking more-addictive features to higher ad revenue, or safety reviews that were overridden on business grounds.
The playbook has already drawn blood. Meta's 2021 internal research โ showing Facebook knew Instagram worsened body image in teen girls โ proved that these documents exist. The financial harm lawsuits assume analogous documents exist for adult users and spending behavior. Getting to discovery phase is the immediate goal of every major filing.
Three Types of Financial Harm in Active Litigation
Impulse purchase amplification. Research from Stanford and NYU has documented that high-engagement users show reduced prefrontal cortex activity โ the region that governs impulse control. Platforms that target ads based on emotional state signals (boredom, anxiety, loneliness inferred from behavior) are, in this framing, targeting users in a neurologically compromised state.
Embedded financial product liability. TikTok Shop, Instagram Checkout, Facebook Pay, and Snapchat's commerce features have turned social platforms into transaction venues. The FTC is now arguing that platforms hosting buy-now-pay-later products, crypto promotions, and in-feed credit applications may carry disclosure obligations similar to regulated financial institutions. If you can open a line of credit without leaving the feed, the regulatory boundary blurs.
Scam facilitation. The $10 billion FTC figure is partly attributable to fraudulent investment ads โ crypto schemes and "pig butchering" scams โ served via precise audience targeting. Several state AGs argue that platforms knew their targeting made specific users more susceptible to financial fraud and ran the ads regardless.
The Cases and Rules Moving Now

MDL 3047 (N.D. Cal.) is the consolidated federal case covering 40+ states and hundreds of school districts. It focuses on adolescent mental health but the discovery phase will surface internal documents relevant to financial harm claims filed in parallel.
FTC dark patterns rulemaking โ the agency's 2024 guidance targets subscription traps, suppressed cancellation flows, and manipulative pricing common in social commerce. Enforcement actions are expected through 2025.
EU Digital Services Act โ now in full effect for large platforms, requiring algorithmic transparency reports. The European Commission has opened formal proceedings against TikTok and X. Fines can reach 6% of global annual revenue. EU enforcement tends to set precedent that U.S. regulators and courts watch closely.
Federal legislation โ the Kids Online Safety Act and proposed adult equivalents โ remains stalled. California, New York, and Texas have state-level frameworks, but a user harmed in Nevada has different legal options than one harmed in California. That patchwork won't hold.
What You Can Do With This Now
If you were defrauded through a platform-hosted scam: File with the FTC at reportfraud.ftc.gov and your state attorney general's office. These complaints form the evidentiary record that enforcement actions are built on. Document everything โ screenshots of the ads, timing, what you'd been browsing.
If you want to understand your ad targeting profile: Under the EU's Digital Services Act, users can request an explanation of why specific ads were served. Some platforms have extended simplified versions of this to U.S. users. Request it. The data is useful for building a legal record or just understanding the targeting logic applied to you.
If you're tracking this for business or investment reasons: Litigation risk is material. Meta's stock moved during the teen mental health news cycle. A financial harm case that reaches discovery and produces damaging internal documents would likely have a similar effect. Reportedly, an estimated three of the four largest social platforms have increased lobbying spend on liability-related issues by double digits since 2022. Companies don't lobby hard against arguments they're confident they'll win.
The Direction of Travel

The era of treating behavioral engineering as legally consequence-free is ending โ not because platforms became less aggressive, but because the legal tools to challenge them finally caught up. Discovery in MDL 3047, EU enforcement actions, and FTC rulemaking are all moving on parallel tracks in 2025.
The financial liability argument is the newest and least-tested front. But it has the most direct connection to measurable consumer harm โ and measurable harm is what courts and regulators are set up to act on. Watch the internal documents. That's where this case gets decided.
